Roger Neely filed a wrongful death lawsuit again DuPont chemical plant and 20 other companies for the death of his mother, Ruby Neely, who died from mesothelioma, an asbestos-related cancer.

Roger Neely filed the lawsuit on behalf of his mother, Ruby, alleging that her cancer was caused by asbestos fibers being carried home on his father’s work clothes while he was employed at DuPont for nearly 20 years.

Lively Neely worked at a local DuPont plant for nearly 20 years, exposing both himself and his family to asbestos fibers. He reached a settlement with DuPont during the 1980s before he passed away from an asbestos-related illness. While working at the plant, he was exposed to asbestos insulation and asbestos-laden equipment.

Neely’s lawsuit claims that DuPont failed to warn employees of the potential dangers of working with asbestos and that asbestos fibers could be carried home on employee’s clothes and hair. Secondhand asbestos exposure has affected thousands of families with relatives who worked with asbestos. Consequently, numerous lawsuits similar to Roger Neely’s have been filed against the company.

The primary cause of mesothelioma is exposure to asbestos. Prognosis is generally poor, as mesothelioma symptoms often imitate those of other illnesses. If you or a loved one have been exposed to asbestos, please contact Drug Alert Updates for additional information.

In Middletown, NY the owner of the former Classy Leather Goods warehouse will be penalized for improper removal of asbestos. The city building inspector received a tip that workers were leaving the premises to dump bags of asbestos-containing materials.

The Labor Department’s Asbestos Control Bureau inspected the building, discovering that it was filled with asbestos. Another warehouse tenant said workers were breaking up the asbestos with sledgehammers, without wearing protective masks.

A Labor Department spokesperson stated that the property owner will be cited for failing to use a contractor certified in asbestos removal; for using workers not certified to perform asbestos removal and for completing the asbestos removal improperly.
Asbestos is a known carcinogen, often leading to mesothelioma and lung cancer. Asbestos removal may only be done by certified workers, following proper procedures and using proper safety equipment. Visit the Times Herald Record for the complete article.

Inver Grove Heights school benefits from Asbestos removal

EnviroTech Remediation Services Inc., a company specializing in the process of asbestos abatement, was cited $13,200 for improper removal of asbestos in the Inver Grove Heights, MN school district.

The Minnesota Pollution Control Agency (MPCA) claims the material was not kept wet to prevent dust, and breakage of the materials could have created an air-borne breathing hazard. The MPCA requires notice of asbestos removal before the process is started.

In lieu of paying the fine to Minnesota’s general fund, EnviroTech chose to perform $12,000 worth of asbestos removal for the Inver Grove Heights school district, free of charge.

An EnviroTech representative states that completing the asbestos removal was a company decision. Fighting the charges would have cost the company more money, and this decision benefited the school district and the MPCA. EnviroTech safely removed 11,000 square feet of ceiling tile and 300 pipe fittings as a result of the project.

What is Mesothelioma?
Mesothelioma is a rare form of cancer that occurs in the thin layer of cells lining the body’s lung, chest, abdomen and heart. In the most common form of mesothelioma, malignant tumors grow on the sac that lines the chest cavity and protects the lungs—the pleura. This is known as pleural mesothelioma, accounting for around 70% of the cases. 2,000-3,000 new cases are diagnosed each year in the U.S.

Who does Mesothelioma affect?
Approximately 70 to 80 percent of people who develop mesothelioma have been heavily exposed to asbestos at work. Shipyard workers, people who work in asbestos mines and mills, producers of asbestos products, workers in the heating and construction industries, and other tradespeople are at higher risk for mesothelioma. There is a long latency period between exposure to asbestos and the development of mesothelioma; usually resulting in decades passing before a person becomes ill.

What is the Cause of Mesothelioma?
Working with asbestos is the main cause of mesothelioma. Asbestos is a naturally occurring mineral fiber, once widely used in building products and materials for its thermal insulating properties and fire resistance. Asbestos is also used in the following products: ceiling and floor tiles, paper products, roofing shingles, transmission and brake parts, heat-resistant fabrics and cement products. Asbestos has no smell or taste, and its fibers are so small that they are not visible to the naked eye. When the fibers are released in the air, people can inhale or swallow the tiny particles. This is especially dangerous in the manufacturing process.

Diagnosing Mesothelioma
Mesothelioma is often difficult to diagnose as symptoms are very subtle. Some common symptoms are shortness of breath, back and side chest pain. Other less frequent symptoms are difficulty swallowing, persistent cough, fever, fatigue and weight loss.
Because diagnosis is often made at an advanced stage of the cancer, average survival time is only about 8-12 months. Some common treatment options include surgery, chemotherapy and radiation therapy, or a combination thereof.
